What if my sister signed a second purchase contract at a dealership under duress.?

She was the victim of "spot delivery" fraud. There was 1 purchase contract that was signed and financed thru the dealer. The loan was never offered to be "shopped around" when they originally purchased the car. 2 days later they got her back in the office for "paper work" and they threatened that she couldn't drive the car unless she signed a second contract. The was under duress to sign the second contract which she wasn't given a copy of. They refused to give her this until she brought the original contract back to them. Now the dealership wants to cancel the deal and I want her to claim contract defense of misrepresentation and duress as well as Unconscionability.

Does the second contract have binding legality with the other one already signed? What do we do?

you hire an attorney in the state where this happened who has experience with this situation. the ultimate resolution depends on both state law and precedent cases in your state.

the non-attorney 'solution' is to make as much noise about unfair dealings as possible. complain to tv news, newspapers, and the state regulatory board for auto dealers. maybe public embarrassment will get them to do the right thing.
