Texas Car Used Law-Mechanic Trouble?

Lyn Arring

I bought a used car from a dealership two months ago, I've made my payments on time and have insurance on it. One day on the way to work the car broke down, and it was towed to the dealership, which they then towed it a couple towns over to a mechanics, a larger dealership. For the first three days of communication the mechanics at this dealership "lost" my car and couldn't find it, didn't even know it was there, then when they finally found it they didn't know it was mine or what it was in there for. I told them what happened and called the next day. They said they have no idea what's wrong with it and they'd call me back. ( They never return any of my calls) I call next week and the receptionist said the mechanic working on my car was "away from his desk" I left my name and number, and once again no call back for the next two days. In less than two weeks I have to make another payment. I'm not entirely sure what my rights are or if they can keep my car for a month while I pay another payment and they keep saying "I don't know what's wrong with it" .

Answer
I assume dealership means brand name dealer like Chevy, Ford, etc, and not an independent dealer like, say, American Used Cars, LLC, which may not be as responsible as the namebrand dealers.

I also assume you'r keeping detailed records of who said what when, and who failed to [unreturned calls, etc] job titles, etc.

Post what your warranty is. A lot revolves around that.

You put "lost" in quotes; If someone actually said that, that'l be good for you if you have to goto court; record their name & job title.

As for them "not knowing what's wrong w/it"...it's their professional duty to know...failing in that duty is Negligence, good leverage for you.

Meet w/ the general manager of the first dealership and ask him if he's aware of the situation. If it's a brand-name dealer, ask him for the names, exact job titles, phones and paper mail addresses of the regional and zone managers & CEO @ headquarters.

When the local dealers have such a lapse in professionalism, they often want to hide it from their superiors, so he should get the message and get this fixed yesterday. If it's not to your satisfaction, write to the above managers about the situation & include some of the quotations you listed in you question. Mail the letters Certified, Return Receipt.

It it's not a brandname dealer, and you cant get a firm committment from the general manager, or they deny warranty coverage, call about 10 lawyers in your area and state that practice consumer law and ask for advice on the phone. Have all you documentation handy.

You might want to search your VIN, Vehicle ID Number, very thoroughly online. It's on your registration and several locations on your car. Sometimes crooked dealers put an bad engine w/ its own VIN in a car whose other VINs are good; that's Fraud. But you can't check those VIN locations on your car till you get it back. But see what you can find online, maybe they laundered the title from, say, Salvage to clean...more Fraud.

I've won some small claims cases and collected all my judgements, and as part of my preparation, I call the lawyers...most are very helpful.

Answer
According to the 2012-2013 Occupational Outlook Handbook (OOH), in 2010 the median salary for automotive service technicians and mechanics was $35,790 per year / $17.21 per hour.

The Handbook profile cited below also has sections on what they do, work environment, how to become one, pay, job outlook, similar occupations and contacts for more info.

Finally, pay for automotive service technicians and mechanics may vary considerably by state. In Alabama, the mean wage is $11.23/hr and in Alaska, the mean wage is 25.04/hr.

You can find mean (average) wages for mechanics and other occupations in your state by visiting the US Dept of Labor Sources of Career Information cited below.
