car accident question... please help? insurance info if available?

ok, my husband,son and i were going to walmart 4/26/08 when a guy ran a stop sign and we hit him... our car wasnt damaged but the guy that ran the stop sign's was. He didnt want to turn it in or anything so since ours wasnt harmed and it was no big deal we let it go(thinking we were doing a favor). Well, not sure how but he found out my husbands name and is now calling him wanting to turn it in- apparently the price to fix the car is higher than he wants to pay. He's acting like he can get us in trouble or something. Is this true? if so we didnt think it was a big deal at the time due to no harm to our property... what advice can someone give me? please anything helpful is appreciated. Is it possible to backdate something because i wouldnt care to do so if possible... it's not going to effect our insurance since it wasn't our fault so i wouldnt mind... but... is this possible? Btw, the state is WV and I have insurance with Safeco.

yeah, it's a weird intersection that looks like a 4-way stop but one lane DOESN't have to stop.. (we were in that lane) he just kinda came out into our lane-not sure if he ran the stop sign or not but still the point is that we had the right of way... just to clarify what happened... ifigure you guys are right about the whole no insurance thing and thats why he didnt want to. This was my first accident so I have already learned..report everything-lol. Luckily I took your guys advice and called my insurance and they are taking care of it. The damage speaks for itself and so does the location it happened. They are sending someone to look at the location and we have to take the car to someone to get it inspected.

The other car ran a stop sign and wants you to pay for it? Granted there is more to the story that what you said in that one line.....but if the other guy is the cause of the accident - your company will not pay him.

Call the guy - get his name, address, phone number, year/make/model of is car, what part damage. Tell him you are going to report it to your insurance company and will have them call him.

Then call your company and report the claim to the. Give them all the information on the guy so they can contact him.

If you want to -- call the guy and then give him the name, phone number and claim number.

Now--- you never have to speak to him again. You do not have to discuss anything with him.

If he calls you after that--- you tell him to call the adjuster.

The insurance company will do an investigation. That includes getting your statement and the statement of the other driver. They will also photograph both vehicles and possibly do a scene investigation.

If the accident is your fault- they will pay the guy. It will protect you from a law suit.

If the accident is not your fault - they will deny his claim. If he files a lawsuit - they will hire a lawyer to defend you.

This is what insurance is for. Let your company deal with it. Just be sure to let the adjuster know any concerns you have and cooperate in the investigation of the claim.

I have a co-worker who was recently in a car accident. Originally, he thought he was at fault but it turns out the other driver was at fault. A few days after the accident his car broke. I am unsure if the damage from the accident caused his car to break, but i do not think so. He will most likely lie and say it was indeed the reason. The vehicle at fault has insurance while my co-worker does not. While discussing this with my boyfriend, we got into an argument about how the insurance agency handles this and if his car will be paid for or not. I may be incorrect, but i thought the police at the scene reported obvious damages, therefore he will not be able to lie about it. If he does, they would have a professional look at the car to determine if the damage from the accident caused the car to break. The owner would then bring the documents to court as proof. My boyfriend believes the insurance company comes and looks at the car, but hadn't yet, therefore he could lie and have the car paid for. This has nothing to do with me, i know, but now i am curious. Someone please explain what would happen in a situation like this. We are in Seattle, Washington if that matters, which i think it does.

Well, you're right that it has nothing to do with you, and you're making a lot of assumptions, but your boyfriend is correct.

Police at the scene merely do a report, who, what, when and where. They don't note damage. If he was unable to provide insurance information he should have received a ticket for that failure.

Regardless, without it he has no one to take his side, and the other insurance *may* state something along the lines of "You had no insurance, so should not have been driving, and if you hadn't been, there would have been no accident. Claim denied." or they may pay for damage caused by their client.

Hard to say which will happen.
